# The Digital Services Act (DSA) Widens Its Scope: Additional Obligations for ChatGPT, Reddit and Roblox

8 September 2026 | Articles, Intellectual property

The Digital Services Act (DSA) is the European regulation on digital services, approved by the European Parliament on 5 July 2022 and definitively adopted by the Council on 4 October 2022 (Regulation (EU) 2022/2065), to protect users and ensure a safer, more transparent online environment. To this end, the regulation lays down particularly stringent obligations for very large platforms and search engines.

The principle underlying the legislation is this: the greater a platform's ability to reach and influence users, the greater its responsibility must be in managing the risks arising from how it operates. That is why the DSA identifies a specific category of services for services with at least 45 million average monthly active recipients in the EU in the European Union, namely **Very Large Online Search Engines** (VLOSEs) and **Very Large Online Platforms** (VLOPs).

It is in this category that the European Commission placed, on 31 August 2026, three prominent names of the digital world: **ChatGPT** was designated as a **VLOSE**, while **Reddit** and **Roblox** were classified as **VLOPs**. All three services declared that they exceed the threshold of 45 million average monthly users in the EU. In more detail, the search function of **ChatGPT** recorded an average well above the limit, with around **159 million monthly users in the EU** in the period ending in March, while **Reddit** and **Roblox** stood at **57.2 million** and **46.6 million** respectively. With the new designations, the total number of platforms and search engines subject to the EU's strictest digital safety regime rises to 28.

#### **What changes with the new designation**

The European decision contains a rather interesting element in the case of ChatGPT. The Commission classified it as a Very Large Online Search Engine, not as an online platform. The reason for this choice lies in the nature of the service: it does not merely interact with users but, through artificial intelligence, can search the web and provide answers based on online information, effectively functioning as a search engine. Reddit and Roblox, by contrast, fall into the category of Very Large Online Platforms, as they allow users to publish and share content.

The new classification is not just a recognition of the size the three services have reached; it entails a series of additional obligations designed specifically to address so-called systemic risks. In concrete terms, the platforms will have to assess and mitigate risks relating, among other things, to the spread of illegal content, the protection of minors, effects on users' physical and mental well-being, fundamental rights, electoral processes and public safety.

For VLOPs and VLOSEs, therefore, the DSA introduces a significantly higher level of responsibility than that provided for other digital services. It is not just a matter of acting on individual reported content, but of analysing more broadly the risks generated by the very functioning of the platform. According to the Commission, ChatGPT, Reddit and Roblox will have up to four months from notification, that is, until the end of December 2026, to comply with these additional obligations.

#### **Greater accountability through stronger oversight and transparency**

Under the DSA, large platforms will have to carry out periodic assessments of systemic risks and adopt concrete measures to mitigate them. This is accompanied by transparency obligations, independent audits and the sharing of certain data with the European Commission, which, under Art. 56 DSA, has exclusive powers to supervise and enforce the obligations specific to VLOPs and VLOSEs.

Particular attention is also paid to recommender systems and advertising. The DSA aims to make the mechanisms through which content is shown to users more transparent and to reduce the risks arising from the way platforms organise information.

#### **How to protect yourself**

Among the illegal content that platforms are required to detect and remove are counterfeit products, a phenomenon the DSA helps to curb by strengthening due-diligence obligations and notice-and-action mechanisms. Online counterfeiting no longer involves only traditional marketplaces: it also runs through social networks, platforms, communities and other digital services capable of connecting millions of users and amplifying the phenomenon enormously. An infringement can appear at any moment and reach a large number of users in a very short time. It is therefore essential to have effective monitoring systems and structured procedures to identify and report infringements promptly.

Among the tools provided for by the DSA, the **trusted flagger** plays a particularly important role: a qualified entity whose reports of illegal content are handled by platforms as a priority.

In Italy, **Argo Business Solutions S.r.l.** was the first organisation in Italy to be awarded trusted flagger status as a trusted flagger under the DSA. Argo's work focuses on constant monitoring of digital channels: identifying suspicious listings, verifying their unlawfulness and sending documented reports to platforms. Trusted flagger status means that these reports are not treated like any ordinary user notice but are handled as a priority, with significantly faster removal times. In practical terms, for companies that rely on Argo this means faster removal than with an ordinary notice, a direct, tracked channel with platforms, priority handling of notices and ongoing monitoring that reduces the reappearance of counterfeit products, with a tangible impact on brand protection and consumer protection.

In an increasingly large and complex digital ecosystem, protecting a brand also means being able to quickly identify infringements and act through the channels provided by law, constantly monitoring what happens online.

Protecting a brand online means acting before the damage spreads. With the brand protection services and the trusted flagger status of Argo Business Solutions S.r.l., you can count on continuous monitoring, priority reports and faster removals.
